Welcome to MindBites. These Terms of Service (the “Terms”) form a binding agreement between you and MindBites (“we”, “us”) regarding your use of the MindBites mobile application and related services (the “Service”). By installing or using the Service you agree to these Terms. If you don't agree, please don't use the Service.
1. Who Can Use the Service
You must be at least 13 years old (or the minimum age required in your country) to use MindBites. If you are under 18, you should review these Terms with a parent or guardian.
2. Your Account
MindBites does not require you to create a signup account. When you first launch the app, we generate an anonymous authentication identifier that lets us save your library and subscription state on your device. You are responsible for keeping your device secure — anyone who uses your device can access your MindBites data.
3. Content
3.1 Our editorial content
The bites, illustrations, audio, and design of the Service are owned by us or our licensors and are protected by copyright and other laws. We grant you a personal, non-exclusive, non-transferable, revocable license to view and listen to the content for your own personal, non-commercial use through the MindBites app.
3.2 AI-generated content
When you use the AI bite feature, the Service creates a new bite based on the topic you provide. AI-generated content is provided for informational purposes only and may contain inaccuracies. You should not rely on it as professional advice (medical, legal, financial, or otherwise). You own the AI-generated bite you request for your personal use, subject to any third-party rights.
3.3 Your prompts
You are responsible for the topics and questions you submit to the AI generator. You agree not to submit content that is illegal, harmful, harassing, sexually explicit involving minors, or that infringes on someone else's rights. We may block prompts or terminate access to the AI feature for misuse.
4. Subscriptions and Payments
- Free tier. You get one free bite each day plus limited use of the AI feature at no cost.
- Premium subscription. Members get unlimited bites, unlimited offline downloads, and additional personal AI bites per day. Subscription prices are shown in your local currency on the App Store and Google Play at the time of purchase and may vary by region.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before renewal.
- Cancellation. Manage or cancel your subscription from the App Store or Google Play account settings on your device. Cancelling stops the next renewal; you keep access until the current period ends.
- Free trial. If offered, a free trial converts to a paid subscription at the end of the trial period unless cancelled at least 24 hours before it ends.
- Refunds. Payments are processed by Apple and Google; refund requests are handled per their respective policies.
5. Acceptable Use
You agree not to:
- Reverse engineer, decompile, or extract source code of the Service.
- Circumvent rate limits, App Check, or subscription gates.
- Scrape or bulk-copy the editorial content.
- Use the Service to build a competing product or a dataset for training your own model.
- Use the Service in any way that violates applicable law.
6. Third-Party Services
MindBites uses third-party services (Google Firebase, Adapty, fal.ai, ElevenLabs, Apple, Google) that have their own terms. Your use of the Service is also subject to those terms where they apply.
7. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that content is accurate or complete. Educational content is for general interest, not professional advice.
8. Limitation of Liability
To the maximum extent permitted by law, MindBites and its providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Service. Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months before the claim, or USD 20 if you have paid nothing.
9. Termination
You can stop using the Service at any time by uninstalling the app. We may suspend or terminate access if you violate these Terms, if we discontinue the Service, or if we are required to by law. Termination does not entitle you to a refund for the unused portion of any paid subscription.
10. Changes to the Service and Terms
We may modify the Service, our pricing, and these Terms from time to time. Material changes will be announced in the app or via the “Last updated” date. Continued use after changes means you accept the new Terms.
11. Governing Law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws principles. If you are a consumer, mandatory consumer protection laws of your country of residence still apply.
